Unemployment benefits partially replace your regular earnings and help you meet expenses while you look for another job.They are not based on financial need. Section 599, part of New York State’s Unemployment Insurance Law, allows unemployed people to continue receiving jobless benefits while attending an approved school or a training program full time. Although Section 599 does not provide tuition assistance, the program includes several advantages for eligible unemployed.
File your claim during your first week of total or partial unemployment. If you wait, you may lose benefits. You may not file for a week when you work four or more days or earn more than $405 gross pay between Monday and Sunday. You must wait until the next Monday to file, if you are still unemployed. Normally, you must apply for training within 15 weeks after you first apply for Unemployment Insurance (UI) to get the extra 26 weeks. The federal government granted extensions to unemployment insurance on January 1, 2013. This means you can apply for training at any time. Find an approved course that will prepare you for the job market. Many New Yorkers who find themselves unemployed go back to school to further their chances of finding new employment. However, there is a myth that going to school disqualifies you from participating in the unemployment program. That’s not true but the New York State Department of Labor (DOL) requires that all claimants meet the same eligibility requirements. College students may have a hard time meeting the previous wages and availability requirements under certain circumstances.

The initial claim application does ask you whether you are currently enrolled in school but answering yes doesn’t disqualify your claim. Previous Wages Concerns
Since unemployment benefits are merit based, the wages you earned before you filed your claim play an important part in determining your eligibility. You must have earned $1,600 in covered wages to claim. Covered wages are those that you earned from work insured by New York unemployment insurance. While most work performed under a traditional employee/employer relationship is covered, if you worked in any capacity for the school you were also attending as a student, it’s not. That excludes wages from most work study or financial aid sponsored positions.
Availability Concerns
New York unemployment claimants must be available to search and take on work if offered a job. College students often have a set schedule of classes that keeps them from looking for work or being available to accept work. If you take night classes, online classes or less than a full-time load, your availability may be more than a full-time student. The DOL reviews each claim individually to determine if your classes would interfere with your availability to search for work or take on work.
Approved Training Exceptions
New York unemployment compensation law allows claimants who are receiving approved training to skip the job search and receive extra benefit weeks in some case. To qualify as approved training, it must take up at least 12 hours a week, be completed within two years and improve your ability to find employment in the New York job market. If you note on your initial claim application that you are a student and the DOL will contact you to go over the requirements.

When you collect unemployment benefits, your state limits the amount you receive each benefit year to prevent abuse of the program. After your benefits run out, you can refile for unemployment or reopen your claim when your benefit year rolls over. Your information is already stored in the state labor system, so refiling a claim is typically an abbreviated process. However, you must meet all of the state eligibility requirements for benefits, including monetary eligibility, which may be difficult if you collected benefits most of the previous year.

Your state labor office must protect the integrity of the unemployment insurance plan for its state. One of the ways it does this is by enforcing a maximum benefit amount per year. The method a state uses to determine your maximum benefit amount varies, but most states either set a percentage of your total base period wages as your maximum. Other states use the credit week system, which determines how many weeks you earned over a certain amount in your base period and multiplies that number times your weekly benefit amount to calculate your maximum benefit amount.
Your Benefit Year
When the word “year” comes up in unemployment compensation, it’s actually your benefit year in question. Your benefit year is the 52 weeks following your initial claim. Even if you go on and off benefits several times through a year, your benefit year doesn’t change. Maximum benefit amounts apply to each benefit year. So if you’ve maxed out your unemployment benefits, you won’t be able to refile your claim until the anniversary of your initial claim date.
Refiling Your Claim
If your unemployment benefits have run out, you must wait until your benefit year ends to refile your claim. Either log into the state labor office’s website or call its claims number. Select the option to reopen your claim using the login credentials you used previously. Verify that your basic information hasn’t changed and enter any new work history you may have when prompted. The state labor office will evaluate your claim application for eligibility.

When you refile a claim, you’re still subject to the same eligibility requirements a new claim would have to meet. One of those requirements, monetary eligibility, may be difficult to meet if you maxed out your unemployment compensation the year before. The state reviews your wages from covered employment for your base period, which is the first four of the last five calendar quarters before you reopen your claim. You must meet the state requirements for income during that time, and if you were claiming unemployment for half the year, this makes it difficult. Some states also require that you work a number of weeks before you can reopen your claim as well.
